1. general

These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts concluded via the website www.shootwithdodo.at and the customer who are consumers.

A consumer is any natural person who enters into a legal transaction for a purpose that can be attributed neither to his commercial nor to his independent professional activity.

2. acceptance of the GTC

The customer acknowledges these GTC and agrees to them as soon as he places an order. The contracting parties agree on the application of Austrian law. If the consumer has his domicile or usual place of residence in Austria or if he is employed in Austria, only the jurisdiction of the court in whose district the domicile, the usual place of residence or the place of employment is located can be established for an action against him; this does not apply to legal disputes that have already arisen.

3. defense clause

The inclusion of general terms and conditions or contractual conditions of the customer, which deviate from these GTC, are rejected, unless they are expressly recognized by shootwithdodo.

4. conclusion of contract

4.1 The product presentation on the website does not constitute an offer in the legal sense. It is an invitation to the customer to make an offer himself. The offer in the legal sense is made by the customer by placing the order. The confirmation of receipt of the order is sent together with the acceptance of the order immediately after sending an e-mail. With this e-mail confirmation, the purchase contract is concluded.

4.2. shootwithdodo sends after receipt of the order a notification e-mail to the e-mail address provided by the customer, in which the receipt of the order is confirmed and its content is reproduced (hereinafter referred to as "order confirmation"). If shootwithdodo rejects the conclusion of the contract, the customer will be informed immediately by e-mail.

5. storage of the contract text

The contract text, i.e. the customer's details regarding the order process, is stored by shootwithdodo and can be viewed by the customer under the link "My account" -> "My orders". Regardless of this, the company shootwithdodo sends an order confirmation.

6. right of withdrawal / cancellation

The right of withdrawal does not apply to:

Goods that are manufactured according to customer specifications or are clearly tailored to personal needs.

7. prices

1. all product prices are total prices; they include the statutory value added tax (VAT).

2. price errors reserved. If the correct price is higher, the customer will be contacted; in this case, a contract will be concluded only if the customer wishes to buy at the actual price. If the correct price is lower, this price will be charged.

8. shipping costs

Shipping costs are added to the indicated product prices. From a certain order value these are not applicable. You can find out more about the amount of shipping costs at Delivery and shipping. The applicable sales tax is included in the shipping costs.

9. delivery conditions

1. unless otherwise agreed, delivery is made to the address specified by the customer. We also deliver to packing stations.

2. the estimated delivery time is indicated directly in the email. The delivery time starts one day after the order is received.

3. the company shootwithdodo is not responsible in case of delivery obstacles in the area of suppliers or manufacturers. If the delivery or the observance of an agreed delivery time becomes impossible by circumstances, which are not to be represented by the company shootwithdodo, the company shootwithdodo is entitled to withdraw from the contract completely or partly. The company shootwithdodo will inform the customer immediately. Claims for damages are excluded in this case. The customer will be informed about existing delivery restrictions before the start of the order process.

10. terms of payment

shootwithdodo accepts the payment methods listed here:

1. in case of payment by buy-it-now, the customer transfers the invoice amount to the account of shootwithdodo within 3 working days after conclusion of the contract (bank details can be seen in the order confirmation and in the imprint). The shipment takes place only after receipt of payment.

2. PayPal - You pay the invoice amount via the online provider PayPal. You must be registered there or register first.

11. warranty

(1) Unless otherwise specified, the general statutory provisions shall apply.

2. the warranty is excluded in case of damage caused by the customer. This is especially the case with improper handling.

If goods are delivered with obvious transport damage, please claim such defects immediately to the delivery company and contact us as soon as possible. This serves to support the supplier in asserting his claims against the company commissioned with the delivery of the goods or the insurance company.

12. disclaimer 

Claims for damages of the customer against the company shootwithdodo are excluded, unless shootwithdodo or its vicarious agents have acted intentionally or grossly negligent.

14 Amendment of the General Terms and Conditions / Reservation of Right to Amend

We are entitled to unilaterally amend these General Terms and Conditions of Business to the extent that this is necessary to eliminate equivalence disruptions that arise subsequently or to adapt to changes in the legal or technical framework conditions. We shall inform the customer of any amendment by sending notification of the content of the amended provisions to the customer's last known e-mail address. The amendment shall become part of the contract if the customer does not object to its inclusion in the contractual relationship in writing or text form within six weeks of receipt of the notification of amendment.

15. severability clause

If any provision of these General Terms and Conditions should be invalid, this shall not affect the validity of the remaining provisions.

16. contract language

The language available for the conclusion of the contract is German.

17. contract law

Austrian law shall apply to the contractual relationship.
